Reclaim Our Town filed our legal response to the other side's Motion to Dismiss. They now have a week to reply.
We are attempting to get a ruling that denies their Motion to Dismiss and allows us to proceed to the Evidentiary Hearing. Everything on the front side of the signature petitions was completely accurate, including the correct Serial Number that was issued to us, and placed by us on the front of the petition.
It is our position that the Town Clerk acted incorrectly by disqualifying all of the signatures based on the small pre-existing number located on the back notary page. This should not have invalidated the over 1800 signatures which would have put the rezone issue on the November ballot.
We are working hard to get the people's voices heard.

After being subjected to the various & changeable versions from the "Town," the local newspaper and one particular Councilwoman (who can't seem to stop inserting herself into this), we make the following statement:
The hard copy paper forms were picked up by Larry Meyers, Treasurer of Reclaim Our Town, on January 18, directly from the Town Clerk. These papers included the signature petition form WITH the tiny pre-existing date printed on the Notary side of the page. Neither Larry or I have ever said it was done on purpose by the Town Clerk. Nonetheless it was indeed the form that was provided to us, copied and circulated to obtain over 1800 signatures from registered voters in Fountain Hills in hopes of putting the measure on the November ballot for a yes or no vote on the rezone.
There was NO FLASH DRIVE provided to us.
Those who signed the petition viewed only the correct information on the front side of the signature petition. This correct information was placed there by Reclaim Our Town and it is our hope that the Town will decide to continue to count, verify signatures and turn them over to the County.
Each circulator got the signature page Notarized which attested that to the best of their knowledge each signature came from a registered Fountain Hills voter. We believe the Town improperly used resources to influence the withdrawal of such signatures in the final days prior to the filing.
The first hearing was March 13, and the case was not dismissed. Another hearing has been set for April 24.
Even though everchanging versions have been pushed out over the past 2 weeks, the statements from Reclaim Our Town have remained constant and are indeed FACT.
As this progresses, Reclaim Our Town will always advocate for the residents of the Town of Fountain Hills as is exemplified by the fact that nearly 20% of all registered voters signed the petition to place the ordinances on the ballot in less than 3 weeks.
